Marcus D. Ellison
Senior Associate
Marcus represents people hurt in motor vehicle collisions, construction accidents and premises cases across the five boroughs. He works on contingency and takes cases to verdict when the offer is not right.

Practice Area
If you were hurt because someone else was careless, the insurer's first offer is not the measure of your claim. It is the measure of what they hope you will accept.
Personal injury cases are won on the record built in the first weeks — the police report, the photographs, the treatment history, the witnesses who are still findable. Most of what determines a case's value happens long before anyone talks about settlement.
Marcus Ellison handles the firm's injury practice on contingency: no fee unless there is a recovery. We advance case costs, deal with the adjusters, and keep the medical providers coordinated so your treatment record does not develop the gaps that insurers use to discount a claim.
Free initial consultation.
Thirty minutes with the attorney who would handle the matter — not an intake screener. Call 000-000-000 or send us the details through the contact form.
How we help
Car, truck, motorcycle, bicycle and pedestrian collisions, including No-Fault benefits and serious injury threshold.
Labor Law 240 and 241 scaffold and elevation claims, falling objects and site injuries.
Sidewalk, stairway, supermarket and premises defect claims against owners and managing agents.
Inadequate security, dog bites, elevator and building code violation claims.
Claims brought by an estate for a death caused by negligence.
Denied benefits, independent medical exam cut-offs and arbitration.
When to call us
If you are not sure whether your situation belongs on that list, call anyway. Telling you that you do not need a lawyer is free, and we would rather do that than take a matter that should not exist.

Questions
Nothing up front. Injury cases are handled on contingency: our fee is a percentage of the recovery, set by New York court rule, and there is no fee if there is no recovery. Case expenses are advanced by the firm and repaid out of the recovery.
Generally three years from the date of the accident, but there are important exceptions — claims against a city or public authority typically require a notice of claim within 90 days, and wrongful death has its own two-year period. Because the short deadlines are the ones people miss, call early.
Not before you have spoken to a lawyer. A recorded statement taken in the days after a collision, while you are still in pain and unsure of the full extent of your injuries, is used later to argue that the injuries are minor. You are not obligated to give one.
Tell us what is going on. The first consultation is free, it is with the attorney who would handle your matter, and there is no obligation afterwards.
